Well I'd say it fits the bill in that he left his feet, used his elbow (unintentionally I'd assume but he still hit with it), and hit the head (again, not maliciously).
But the whole intent thing was apparently enough to not suspend. I'm not losing sleep over it.

It wasn't about TDs at that point. He makes the catch, they start burning clock. They either score a TD or give the Giants the ball back with not a lot of time left. That's why it was a big deal.
