New CBA gives teams the right to carry over cap space automatically

As the NFL readjusts to the problems that arise from spending that once again will be approaching the annual salary cap, there’s an important provision of the new Collective Bargaining Agreement that needs to be highlighted.

Under Article 13, Section 6(b)(v) of the CBA, each team may carry over any remaining cap room from one year to the next by submitting written notice, signed by the owner of the team, to the league office no later than 14 days before the start of the next league year. The written notice must indicate the maximum amount of cap room that the team wishes to shift from one cap year to the next.

This relatively simple device replaces past tools for carrying over cap space, which included (for example) loading up a renegotiated player contract with a phony “likely to be earned” incentive that would chew up space in one year and then trigger a refund to the cap in the next year.

What’s odd about the new procedure is that teams must affirmatively choose to carry over the cap space. If a team wishes to be competitive, why wouldn’t all remaining cap space be carried over in any and every given year?

The last time we updated the 2011 cap dollars, the Jaguars had $32.9 million in space. The Chiefs had $27.4 million, the Broncos had $25.6 million, the Bucs had $25.1 million, the Seahawks had $21.7 million, and the Bills had $20.9 million.

The fans in each city should be clamoring for the maximum remaining cap room to be carried over, and the media in each city should be poised to get a full explanation if the full amount isn’t carried over.

Meanwhile, we’ll try to think of a plausible explanation for not carrying over the cap space. If nothing else, the excess cap space from 2011 will create excess cap space in 2012 that can be carried into 2013, and so on, until the need arises to use it.

With the new league year beginning on March 13, the notices must be submitted by February 28.

Cap Room

The new CBA has, for the first time, provided teams a valuable benefit: the ability to carry over remaining Cap room into the following year.

In the past, teams would have to go through the charade of “dummy incentives” in order to bring forward Cap room into the next year. I would usually negotiate with our third-string quarterback in the final week of the season with a bonus of “$10 million for 7 touchdown passes.”

The $10 million would then count on the existing Cap and, when unearned, be credited to the next year’s Cap (although there was a scary moment one year where the player with the bonus, Craig Nall, ended up playing most of the final game due to having clinched our playoff spot!).

Teams no longer need to go through that charade. Thus, teams will have adjusted Caps of much more than the projected 2012 Cap number of around $125 million. A team like the Buccaneers, for example, with $25 million remaining in Cap room, may have an adjusted 2012 Cap of close to $150 million.

The question for the NFLPA is: will teams actually spend all of this Cap room? Keep in mind, there are no team spending minimums until 2013, and teams can “free ride” this year and next.

I never once doubted the cap-carry over thing. But the Jags still dont have the most cap space, the Bengals do.

If you take the numbers before taking out the cap space from 2011, you have team salaries of

CIN: $80,641,237
JAX: $107,270,274

Then, take out the 2011 cap, you have:

CIN: $80.64 - $17.59 = 63.05
JAX: $107.27 - $31.66 = 77.61


Bengals still have more cap space.

JAX: $107,270,274

Then, take out the 2011 cap, you have:

Bengals still have more cap space.

Those are the salary numbers without the 2011 salary cap relief. Thats been posted, literally, everywhere. Bengals have more cap space.

Jags prolly put better use of that space than Cincy does, but I'm just saying... Cincy has more cap space

& Regardless, I was still correct.. Because the Jaguars will still have enough cap to sign a DE that can contribute, and a top WR in FA. & Thats what we're going to do.

I don't know what's what, it doesn't even matter. The Bengals can have the most cap space with lots of money to spend and they won't spend any anyways, so it really doesn't much matter where they are.

& They are saying the Jags are on the hook for 107 Million, which seems highly unlikely. Go look up team salarys anywhere, while they don't have all the players listed.. They have about 39 of them, and its NOWHERE close to 107 Million. They're wrong. Could be also counting players like Garrard, etc who don't count on the cap anymore.

$17 million (2012) + $32 million (2011) = Approx $49 million.


So, Jags are more than good in terms of having money to throw around this offseason.
