No it isn't. It's a known tech to throw it out of bounds to delay the team's offense. He just lightly tossed it to Battier. That is not a technical.

Miami has earned their lead, but favoritism on the officials' behalf is keeping it for them. Ticky-tack fouls called on Boston, whereas Miami has to hammer the Celtics in order to be called for a foul.
